What began as a dispute over a ritual performed at a political rally venue has now moved into a formal criminal investigation.
Uttarakhand Police have registered an FIR against unidentified people over the alleged “purification” of Ramlila Maidan in Haldwani following a public meeting addressed by Congress president Mallikarjun Kharge on August 8.
The case was filed at Haldwani Kotwali on the complaint of Anju, a local lawyer and social activist. Police have invoked Sections 196 and 299 of the Bharatiya Nyaya Sanhita, along with Section 3(1)(r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The police action comes after weeks of complaints, protests and exchanges between Congress and BJP leaders. Authorities said around 80 representations and complaints concerning the episode had been received across Uttarakhand, including 19 in Nainital district.
The FIR establishes that the allegations will be investigated. It does not establish that an offence occurred or determine responsibility for it.
The Dispute Began Two Days After Kharge’s Rally
Kharge addressed a Congress gathering at Haldwani's Ramlila Maidan on August 8.
Two days later, a ritual described as “shuddhikaran”, or purification, was allegedly conducted at the venue. Reports referred to cleaning of the ground and the performance of a havan.
The ritual became politically contentious because of allegations about why it had been organised.
Kharge belongs to a Scheduled Caste community. Congress leaders and complainants argued that presenting the venue as requiring purification after his visit amounted to a caste-based insult.
That interpretation lies at the heart of the complaints but remains an allegation. Establishing the purpose of the ritual, who organised it and what was said in connection with it will be central to the investigation.
Police Act After Complaints Mount
The FIR is based on a complaint submitted by Anju, a lawyer and social activist in Haldwani.
She approached the authorities after the August episode, alleging that the actions and statements surrounding the ritual were discriminatory towards Kharge because of his Scheduled Caste background.
The controversy generated considerably more than one complaint.
Nainital Senior Superintendent of Police Manjunath T.C. said authorities received representations from political organisations and other groups across the state. Around 80 complaints or petitions were submitted, with 19 coming from Nainital district.
Police have registered the Haldwani case against unidentified people rather than naming individuals as accused at this stage.
That places the immediate burden on investigators to establish who organised or participated in the alleged activity and whether the available evidence supports the offences included in the FIR.
What the Legal Provisions Cover
The combination of provisions cited by police reflects the two central allegations surrounding the episode: that the conduct promoted hostility and that Kharge was targeted because of his caste.
Section 196 of the Bharatiya Nyaya Sanhita covers specified acts that promote enmity between groups and conduct considered prejudicial to harmony.
Section 299 deals with deliberate and malicious acts intended to outrage religious feelings.
Police have also invoked Section 3(1)(r) of the SC/ST (Prevention of Atrocities) Act, which covers intentional insult or intimidation intended to humiliate a member of a Scheduled Caste or Scheduled Tribe within public view.
Invoking those provisions does not mean their requirements have already been proved.
Investigators will have to examine evidence surrounding the ritual, including the identities of those involved, statements made at the time and material that could help establish intent.
Kharge Took the Issue to Parliament
The political argument had reached New Delhi well before the FIR was registered.
Kharge raised the Haldwani episode in the Rajya Sabha on August 13.
J.P. Nadda, the Leader of the House, condemned what had been reported and said the incident should be investigated.
When no FIR followed for more than three weeks, Kharge wrote to Nadda and referred to the assurance given in Parliament. He questioned the delay in taking action against those allegedly responsible.
The absence of a police case consequently became a second point of dispute, separate from the original allegations about the ritual itself.
Registration of the Haldwani FIR resolves that procedural question, but not the underlying factual dispute.
Congress MPs Press Police in Delhi
Congress lawmakers also sought action outside Uttarakhand.
A delegation of Congress MPs from Scheduled Caste and Scheduled Tribe communities approached the Parliament Street police station in New Delhi seeking an FIR over the Haldwani episode.
Their visit resulted in a prolonged confrontation with police, according to reports.
Delhi Police later informed the MPs that an FIR had been registered in Haldwani and provided them with a copy.
For Congress, the dispute has consistently been framed around the alleged humiliation of its president on the basis of caste. Whether investigators find evidence sufficient to support that allegation under the SC/ST Act will be one of the central legal questions in the case.
Bengaluru Police Had Earlier Registered a Zero FIR
Police action related to the controversy had already begun elsewhere.
Bengaluru Police previously registered a Zero FIR following a complaint by T.R. Ramappa, a former vice-chairman of the Congress's ST Department.
That complaint named Uttarakhand BJP president Mahendra Bhatt and other party members and alleged their involvement in the purification episode.
A Zero FIR allows a police station to register information about an alleged cognisable offence even when the incident occurred outside its territorial jurisdiction. The case can subsequently be transferred to the police station with jurisdiction over the location where the alleged offence occurred.
The Bengaluru complaint and the new Haldwani FIR concern the same wider controversy but are separate legal actions. Neither should be read as a finding of guilt against those accused or alleged to have been involved.
Investigation Must Now Establish What Actually Happened
For several weeks, the Haldwani episode was argued largely through political statements.
The FIR changes the nature of the dispute.
Investigators can now examine who organised the alleged purification, who participated, what statements accompanied it and whether video, photographs, witness accounts or other material support the allegations made by complainants.
Intent will be particularly important. The existence of a ritual alone does not resolve whether it was directed at Kharge, whether it was linked to his caste or whether the conduct satisfies the legal tests contained in the provisions invoked by police.
Those are questions for the investigation rather than conclusions that can be drawn from the political controversy.
The case has already travelled from Haldwani to Parliament and police stations outside Uttarakhand. Its next stage will depend less on competing political interpretations and more on what investigators can establish from the evidence.
